Acceptance of terms
By accessing or using our website, applications, or related services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our services.
You represent that you have the legal capacity to enter into these Terms. If you use our services on behalf of an organization, you represent that you have authority to bind that organization.
Services provided
Iterative.Design.Project, LLC provides individualized performance consulting, educational resources, and technology tools designed to support health, wellness, recovery, hydration, behavior tracking, and performance processes for elite athletes and high performers.
Our technology applications are developed selectively to extend advisory work — they are not standalone software products distributed for general consumer use. Features available to you may depend on your relationship with us and the specific application you access.
We may modify, suspend, or discontinue any part of our services at any time. We will make reasonable efforts to notify users of material changes that affect active application functionality.
No medical care
Our services are performance and wellness tools. They do not replace professional medical care.
- Iterative.Design.Project, LLC does not diagnose, treat, prescribe, or provide emergency medical services.
- Information provided through our website, applications, or consulting is not a substitute for evaluation or treatment by a licensed physician or qualified medical provider.
- If you have a medical concern, injury, or emergency, consult your physician or seek immediate medical attention.
Nothing in these Terms creates a physician-patient or provider-patient relationship.
User responsibilities
You are responsible for your use of our services. This includes:
- Providing accurate and complete information when using our applications or engaging with our services
- Using applications appropriately and in accordance with these Terms and applicable law
- Maintaining the security of your account credentials and authorized device access
- Consulting qualified medical professionals when appropriate for health-related decisions
- Reviewing and managing permissions you grant to third-party integrations (such as Google or Apple HealthKit)
Data and app functionality
Application functionality may depend on data you provide or authorize. This may include integrations with:
- Google Sign-In for authentication
- Google Sheets for storing or retrieving user-authorized data
- Apple HealthKit for health and wellness data you choose to share
- Wearable devices and performance platforms you authorize
- User-entered notes, behaviors, logs, and performance information
You are responsible for the permissions you grant. Revoking access to authorized data sources may limit or disable certain application features. Our data practices are described in our Privacy Policy.
Performance information disclaimer
Performance insights, dashboards, trends, and feedback provided through our applications or consulting are informational and educational in nature.
- No specific performance outcome is guaranteed.
- Individual responses to training, recovery, and performance strategies vary.
- Application outputs should be interpreted in context and are not definitive assessments of health or performance capacity.
You are responsible for how you apply information from our services within your own performance process.
Consulting engagements
Performance consulting services may be offered separately from application access. Any paid consulting engagement is governed by a separate written agreement between you and Iterative.Design.Project, LLC.
In the event of a conflict between these Terms and a signed consulting agreement, the consulting agreement controls with respect to that engagement.
Intellectual property
All content on our website — including text, design, systems, application interfaces, logos, and materials — is owned by Iterative.Design.Project, LLC or its licensors, unless otherwise stated.
We grant you a limited, non-exclusive, non-transferable license to access and use our services for their intended purpose. You may not copy, modify, distribute, or create derivative works from our content except as expressly permitted.
Acceptable use
You agree not to misuse our services. Prohibited conduct includes:
- Attempting unauthorized access to our systems, accounts, or data
- Reverse engineering, decompiling, or extracting source code except where permitted by law
- Disrupting or interfering with the operation of our website or applications
- Using our content or services for unlawful purposes
- Misrepresenting your identity or affiliation when using our services
We may suspend or terminate access for conduct that violates these Terms or poses risk to our services or other users.
Third-party services
Our applications may integrate with third-party services such as Google, Apple, wearable platforms, or cloud infrastructure providers. Your use of those services is subject to their respective terms and privacy policies.
We are not responsible for third-party services and do not control their policies or practices. Integration with a third-party service does not imply endorsement beyond the functional requirements of our applications.
Limitation of liability
To the fullest extent permitted by applicable law, Iterative.Design.Project, LLC and its founder, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
Our total liability for any claim arising from these Terms or your use of our services shall not exceed the amount you paid us for the specific service giving rise to the claim during the twelve months preceding the claim, or one hundred U.S. dollars ($100), whichever is greater.
Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability is limited to the greatest extent permitted by law.
Our services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, except where such disclaimers are not permitted by law.
Changes to terms
We may update these Terms from time to time. When we make material changes, we will update the effective date at the top of this page. Your continued use of our services after changes become effective constitutes acceptance of the updated Terms.
